Offer for the provision of services.

This document is a public offer by Anna Omelchenko, an individual entrepreneur registered in Georgia (trading as "Nevidio" / "IskraVPN"), to conclude a service agreement on the terms set out below. By ordering and paying for a subscription, you accept these terms in full.

The Russian version is the primary version. This English version is a convenience translation; in case of discrepancy, the Russian text prevails.

01 General

This offer is addressed to an indefinite range of persons and is the Provider's official public proposal to conclude a service agreement (the "Agreement") on the terms below.

Acceptance of the offer (full and unconditional acceptance of its terms) is any of the following: ticking the box confirming agreement with the offer during checkout, or paying for a subscription. The Agreement is concluded upon acceptance.

02 Definitions

• Provider — Anna Omelchenko, an individual entrepreneur registered in Georgia (details in Section 15).
• User (Customer) — an individual who has accepted the offer.
• Service — the IskraVPN application and related secure-connection services that use VPN protocols and other traffic-transport technologies.
• Subscription — the right to use the premium features of the Service for the paid term.
• Website — the Provider's website at nevidiovpn.com.
• Activation code — the code sent to the Customer after payment to enable premium access in the app.

03 Subject of the Agreement

The Provider grants the Customer access to the Service — an app that establishes an encrypted connection between the Customer's device and the Provider's servers using VPN protocols and other traffic-transport technologies. The scope of features is set by the chosen plan.

The list of plans, their consumer characteristics (speed, number of devices, exit countries, access term), and prices are shown in the Plans section of the Website and in the app. That list is an integral part of the offer.

04 Price and settlements

The subscription price is shown on the Website in rubles and includes all applicable fees. The applicable price is the one displayed on the Website at the time of ordering. Payment is made once for the chosen term (month or year).

05 Payment

Payment is made by bank card (Visa, Mastercard, Mir) or via the Faster Payments System (SBP). Payments are accepted by a payment provider on its secure page. Card details are entered on the provider's side and are not passed to the Provider; the Provider does not store card details.

The payment obligation is deemed fulfilled once the Provider receives confirmation of a successful payment from the payment provider. The payment procedure and security measures are described on the Payment & security page.

06 Provision and activation

The service is delivered digitally. Premium access is activated automatically right after payment is confirmed. The activation code and receipt are sent to the email provided by the Customer.

The service is deemed to have been provided properly and in full from the moment premium access is granted to the Customer (the activation code is sent) for the entire paid term.

07 Term and renewal

A subscription is valid for the paid term. A term purchased on the Website does not renew automatically — once it ends, you can order a new subscription. We notify you in the app as the term approaches its end.

08 Refunds

The Customer may withdraw from a new subscription and receive a full refund within 14 days of payment. Conditions, exceptions, and the procedure are set out in the Refund Policy, an integral part of the offer.

09 Rights and obligations

The Provider undertakes to

• Provide access to the Service in line with the chosen plan.
• Maintain the Service and provide support through the stated channels.
• Process personal data in accordance with Section 12.

The Customer undertakes to

• Provide accurate information when ordering.
• Use the Service within the acceptable-use rules (Section 10).
• Keep the account identifier and activation code safe.

10 Acceptable use

The Customer agrees not to use the Service to:

• violate any applicable law;
• send unsolicited bulk communications (spam);
• distribute malware or attack other systems;
• distribute child sexual abuse material;
• infringe intellectual property rights;
• resell access to the Service without the Provider's written permission.

The Provider may suspend or terminate access if these rules are breached.

11 Liability and availability

The Service is provided "as is" and "as available". The Provider makes reasonable efforts to keep it running but does not guarantee uninterrupted operation and may perform maintenance.

To the maximum extent permitted by applicable law, the Provider's total aggregate liability for any claim related to the Service is limited to the amount paid by the Customer in the 12 months preceding the claim, or €100, whichever is greater. Nothing in the offer limits liability that cannot be limited by law.

12 Personal data

The Customer's personal data is processed in accordance with the Privacy Policy and the Personal Data Processing Policy. By accepting the offer, the Customer confirms agreement with them.

13 Term and amendment of the offer

The offer is valid from the date of publication until withdrawn by the Provider. The Provider may amend the offer; changes take effect upon publication of the new version on the Website. An already concluded Agreement is governed by the version in force at the time of acceptance.

14 Governing law and disputes

The Agreement is governed by the laws of Georgia. Disputes are resolved by the competent courts of Georgia at the Provider's place of registration. If you are a consumer, you may also rely on the mandatory consumer-protection rules of your country of residence and bring proceedings in the courts there.

15 Provider details
